DISCRETIONARY DECISIONS APPROVED BY MUNICIPAL PLANNING COMMISSION

DEVELOPMENT PERMITS

No development shall take place within the County unless an Application has been approved and a Development Permit has been issued.

Development Permits are required for any new construction, any disturbance of land, or any changes in use for the existing structures.

Applications can be obtained from the County Office or website (www.smokylakecounty.ab.ca) and submitted as follows:
 

  • Development Permit Application Form completed and signed

  • Site Plan

  • Application Fee (choose category):

    - RESIDENTIAL - $ 50.00
    - COMMERCIAL - $ 100.00 minimum - $ 200.00 maximum
      ($1.00 per $1,000.00 value of development)
    - INDUSTRIAL - $ 200.00 minimum - $2,000.00 maximum
      ($1.00 per $1,000.00 value of development)
    - RESOURCE EXTRACTION - $ 500.00 per acre

The Development Authority Officer or the Municipal Planning Commission may also require additional information in order to assess the conformity of a proposed development with the Land Use Bylaw before consideration of the Development Permit Application shall commence.

A Development Permit must be approved prior to receiving any other Permits, such as Building, Plumbing and Electrical, from the Inspections Group.

SUBDIVISION APPLICATIONS

Council has appointed Municipal Planning Services (2009) to be the Subdivision Authority for Smoky Lake County.

Applications for Subdivision are available at the County office and are submitted with fees directly to:

Once the Subdivision Application is conditionally approved, the Applicant must enter into a Development Agreement with Smoky Lake County to ensure that the following minimum conditions are met:

• Appropriate access / approach has been provided to each new parcel;
• One hundred dollar ($100.00), per parcel fee has been paid to County;
• Current taxes for property are paid in full, and if applicable
• Money-in-Lieu of Reserve has been paid in full to County (see following)

Municipal Reserve
The purpose of the Municipal / School Reserves dedication is to provide for public use land, either by the municipality or by the school district for future use and development (i.e: park space, school site, etc.) Where reserve land is owing pursuant to Section 666 of the Municipal     Government Act and upon decision of the Subdivision Authority, Council will require the following actions to be taken:

Country Residential Subdivisions
First Parcel Out
– A deferred caveat on the balance of the parcel will be required by the County at the time of approval of the subdivision

Second & Third Parcels Out – Money-In-Lieu will be required for second and third parcels subdivided out of quarter sections, according to ten percent (10%), based on one thousand dollars ($1,000.00) per acre.

Money-In-Lieu may be dedicated to be used for recreational / school purposes, at the sole discretion of Council

AREA STRUCTURE PLANS (ASP)

GARNER LAKE AREA STRUCTURE PLAN

The goal of the ASP is to establish a long term vision for the community as well as set in place policies and guidelines to guide land use and development in the area. 

One of the most important steps in the planning process is to receive input from stakeholders and community members about the issues, opportunities and constraints affecting the Garner Lake Area, in order to ensure that the policies enshrined in the completed ASP are both tenable and achievable. 

This feedback, once compiled, will enable the completed ASP to more accurately reflect the goals and aspirations of community members and stakeholders groups.  As such, the Council, staff and Municipal Planning Services (Alberta) Ltd. would like to invite you to attend the project information session and/or Open Space Management and ASP Workshop to learn about the Areas Structure Planning process and share with us your vision for the future of the Garner Lake community.

On Saturday, July 25, 2009, a workshop was held, in an effort to provide attendees information about the lake ASP process and also give the public the opportunity to contribute to the creation of a comprehensive vision for the Garner Lake community.

With over 125 people attending the one hour information session and close to 50 people participating in the workshops, the day was considered to be a huge success.
